1. Agreement to Terms

By accessing or using the Bramble mobile application and website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Bramble is a social platform that helps users connect with friends and organize real-world events and activities.

2. Description of Service

  • Connect with friends and build social networks
  • Create and organize real-world events and activities
  • Invite friends to join the platform via SMS messages
  • Discover events and activities in their area
  • Manage their social connections and event preferences

3. Eligibility and Account Registration

Age Requirement

You must be at least 18 years old to use the Service. By using our Service, you represent and warrant that you are 18 years of age or older.

Account Security

  • You are responsible for maintaining the security of your account and password
  • You are responsible for all activities that occur under your account
  • You must provide accurate and complete information when creating your account
  • You must promptly notify us of any unauthorized use of your account

4. SMS and Contact Invitation Terms

Contact Invitation Feature

Bramble offers a feature that allows you to invite friends to join the platform via SMS text messages. By using this feature, you agree to the following terms:

Contact Access: When you choose to use our invitation feature, you can opt-in to grant us temporary access to your device's contact list solely to display your contacts within the app and facilitate invitations.

Message Sending: We will send SMS invitation messages only to contacts you specifically select. These are one-time, transactional messages sent through our SMS service provider (Twilio).

Consent and Responsibility: By sending an invitation to a contact, you represent that:

  • You have a pre-existing relationship with the person you're inviting
  • You have their phone number legitimately stored in your contacts
  • You believe they would be interested in receiving an invitation to join Bramble

One-Time Messages: We send only one invitation message per contact per user. We do not send follow-up messages unless the invited person joins our platform and explicitly opts in to receive communications.

Opt-Out Compliance: All invitation messages include clear opt-out instructions. Recipients can reply "STOP" to opt out of future invitations. We maintain and honor all opt-out requests.

No Spam: You agree not to use our invitation feature to send unsolicited messages or spam. Misuse of this feature may result in account termination.

Message and Data Rates: Standard text messaging rates may apply to invitation messages sent and received. We do not charge for sending invitations, but your mobile carrier may charge the recipient for text messages.

5. Acceptable Use

  • You may not use the Service for any illegal or unauthorized purpose
  • You must not violate any laws in your jurisdiction while using the Service
  • You will use the contact invitation feature responsibly and only invite people you know
  • You will not send unsolicited promotional or commercial content through our platform
  • You will not attempt to bypass any measures designed to prevent or restrict access to the Service
  • You will not attempt to access features or areas of the Service that you are not authorized to access
  • You will not post, share, or transmit content that is hateful, threatening, harassing, sexually explicit, obscene, violent, or otherwise objectionable
  • You understand that Bramble has a zero tolerance policy for objectionable content and abusive behavior, and that violations may result in immediate content removal and permanent account termination

6. User Content and Conduct

Content Responsibility

Our Service allows you to post, share, and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You are responsible for the Content that you post on or through the Service, including its legality, reliability, and appropriateness.

Content Rights and License

  • Grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display your Content solely for the purpose of providing our Service
  • Represent and warrant that you own or have the right to use such Content
  • Confirm that posting your Content does not violate any third-party rights

Prohibited Content and Activities

    You agree not to post, share, transmit, or facilitate content or behavior that:

  • Is hateful, harassing, threatening, or discriminatory based on race, ethnicity, gender, religion, sexual orientation, disability, or any other protected characteristic
  • Is sexually explicit, obscene, or pornographic
  • Depicts or promotes violence, self-harm, or illegal activity
  • Constitutes spam, phishing, or deliberately false or misleading information
  • Infringes on the intellectual property or privacy rights of any person or entity
  • Involves impersonation of any person or entity
  • Is used to organize events that promote illegal activities
  • Harasses, abuses, stalks, or threatens another person
  • Is otherwise objectionable or harmful to other users or the Bramble community

Bramble maintains a zero tolerance policy for objectionable content and abusive users. Violations may result in immediate content removal, account suspension, or permanent termination without prior notice.

Reporting Objectionable Content

If you encounter content that violates these Terms, you may report it directly within the app using the flag or report feature available on events, posts, and user profiles. Bramble will review all reports and take appropriate action, which may include removing the content and suspending or permanently terminating the responsible account. Bramble commits to reviewing flagged content within 24 hours of submission. Where a violation is confirmed, we will remove the content and take action against the responsible account.

Blocking Abusive Users

If you encounter an abusive user, you may block them using the block feature available on any user profile. Blocking a user will:

  • Immediately remove that user's content from your feed
  • Prevent further interaction between you and the blocked user
  • Automatically notify Bramble's moderation team, who will review the situation

7. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and sharing of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Service, you consent to the collection and use of your information as described in our Privacy Policy.

8. Intellectual Property Rights

Our Rights

The Service and its original content (excluding user-generated Content), features, and functionality are and will remain the exclusive property of Bramble and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used without our prior written consent.

Respect for Others' Rights

You agree to respect the intellectual property rights of others and not to post or share any content that infringes on others' copyrights, trademarks, or other intellectual property rights.

9. Fees and Payment

Current Free Service

The Service is currently provided free of charge. However, we reserve the right to introduce fees for certain features or services in the future.

Future Paid Features

  • We will provide advance notice of any fees
  • You will have the option to accept or decline paid features
  • Continued use of paid features constitutes acceptance of applicable fees
  • All fees are non-refundable unless otherwise specified

10. Termination

Termination by Us

Bramble reserves the right to suspend or permanently terminate any account, with or without prior notice, for:

  • Breach of these Terms
  • Posting objectionable content or engaging in abusive behavior toward other users
  • Violation of applicable laws
  • Fraudulent, abusive, or illegal activity
  • Extended periods of inactivity

Users who are found to have posted objectionable content or engaged in abusive behavior may be permanently ejected from the platform and barred from creating new accounts. Content posted by terminated users will be removed from the platform. If you believe your account was terminated in error, please contact us at appcontact+legal@brambleisthebomb.com.

Termination by You

  • Deleting your account through the app settings
  • Contacting us directly to request account deletion
  • Simply discontinuing use of the Service

Effect of Termination

  • Your right to use the Service will immediately cease
  • We may delete your account and all associated data
  • Some provisions of these Terms will survive termination

11. Disclaimers and Limitation of Liability

Service Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BRAMBLE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content

Maximum Liability

Our total liability to you for any claims arising from or related to these Terms or the Service shall not exceed $100 or the amount you have paid us in the past 12 months, whichever is greater.

12. Indemnification

You agree to defend, indemnify, and hold harmless Bramble and its officers, directors, employees, agents, suppliers, and licensors from and against any claims, damages, costs, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your use of the contact invitation feature

13. Governing Law and Dispute Resolution

Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California and the United States, without regard to conflict of law provisions.

Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in San Diego, California.

14. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.

Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will remain in effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.

Force Majeure

We shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control.

15. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect through email notification or a prominent notice in our Service.

By continuing to access or use our Service after revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
